1. Introduction

This agreement (hereinafter “Agreement”) outlines the terms between you or the entity you represent (“You” or “Customer”) and Clickmarks (“Clickmarks” or “Service”) regarding the use of Clickmarks and its services. The Agreement includes the terms and conditions (hereinafter “Terms”).

2. Changes to Terms

Clickmarks reserves the right to update and change these Terms of Use without notice. Your continued usage of Clickmarks after any changes constitutes your consent to those changes.

3. Basic Terms

  • You must be 18 years or older to use Clickmarks.
  • Signups by bots or automated methods/tools are not allowed.
  • Customer must provide accurate information during signup.
  • Customer is responsible for all account activity.
  • Violation of terms can result in termination or account restriction.
  • Customer agrees to use the Service at their own risk.

4. Trial Period

  • Clickmarks provides a 14-day evaluation trial.
  • Trial is limited to non-productive evaluation use.
  • Commercial activity during the trial waives remaining trial time.
  • Customer may terminate during the trial period with 1-day notice.
  • No charges during the trial; subscription starts at the end of the trial.
  • Trial limited to one-time use per customer/entity.

5. Payment & Fees

  • Payments processed by Credit Card.
  • Billing is monthly, starting from signup date.
  • All fees are exclusive of taxes, levies, or duties.
  • Clickmarks does not provide refunds or credits.

6. Termination

  • Customer can cancel the account at any time.
  • Access is terminated upon cancellation.
  • No charges if canceled before the end of the current billing period.
  • Clickmarks may suspend or terminate accounts for any reason.

7. Service & Pricing Modifications

  • Clickmarks may modify the Service with or without notice.
  • Prices subject to change with 14 days notice.
  • Clickmarks not liable for modifications, price changes, or suspension.

8. Confidentiality & Proprietary Rights

  • Customer owns rights to Customer Data & Content.
  • Clickmarks owns rights to Services, Software, and related technologies.
  • Clickmarks has the right to collect and analyze data for improvement.

9. Customer Data Security

  • Clickmarks is responsible for protecting Customer Data.
  • Security measures may not be suitable for all businesses.
  • Customer agrees to implement additional controls as needed.

10. General Conditions

  • Service provided on an “as is” and “as available” basis.
  • Technical support provided via email and online chat.
  • Clickmarks may remove objectionable content or accounts.
  • Customer data must not facilitate illegal, deceptive, or fraudulent activities.
  • Click usage exceeding the monthly limit may result in account suspension.
  • Clickmarks is not liable for certain damages; liability limited to amount paid.
